Lakewood Property Owners Association Pavilion Use Agreement
This Pavilion Use Agreement (“Agreement”) establishes the rules and responsibilities for use of the Lakewood Property Owners Association (“LPOA”) Pavilion and associated common areas. The LPOA member making the reservation (“Member”) is responsible for the event and for ensuring that the Member’s guests and participants comply with this Agreement.
1. PURPOSE OF USE
The Pavilion is provided primarily for the use and enjoyment of eligible LPOA members and their guests for social, recreational, and community purposes.
2. ELIGIBILITY
The Pavilion may be reserved only by a dues-paying LPOA member in good standing who is at least 18 years of age.
The Member making the reservation must:
- Make the reservation in their own name;
- Provide current contact information;
- Accept responsibility for the event and guests; and
- Be present for the duration of the reserved event.
A Member may not reserve the Pavilion solely to provide facility access to a non-member. The Member remains responsible for the reservation even when the Pavilion is being used primarily by the Member’s children, household members, guests, or an invited group.
3. RESERVATIONS
The Pavilion must be reserved in advance using the LPOA Pavilion Reservation Request. Reservations are accepted on a first-come, first-served basis and are not confirmed until approved by LPOA.
The Member must provide:
- The requested reservation date;
- Anticipated start and end time;
- A valid telephone number where the Member can be reached on the day of the event; and
- Any other information reasonably requested by LPOA for scheduling or facility use.
Reservation Period
The Pavilion is reserved for the Member during the approved reservation period. Reasonable setup and cleanup time must be included within the requested reservation period unless otherwise approved by LPOA.
The Member is responsible for ensuring that:
- The event concludes on time;
- Guests leave the Pavilion at the conclusion of the reservation;
- Cleanup is completed;
- Personal belongings and decorations are removed; and
- The Pavilion and any accessed areas are properly secured before leaving.
Reservations are not transferable. The Member who submits the reservation remains responsible for the reservation and must be present during the event.
A Pavilion reservation provides exclusive reservation of the Pavilion itself during the approved reservation period but does not provide exclusive use of the lake, boat ramp, playground, park, roads, parking areas, or other Lakewood common areas.
4. CANCELLATIONS & CHANGES
Members should notify LPOA as soon as reasonably possible if a reservation must be cancelled or changed. LPOA may cancel, relocate, or reschedule a reservation when reasonably necessary because of maintenance, unsafe conditions, severe weather, emergencies, Association needs, or other circumstances affecting safe or appropriate use of the property.
5. MEMBER RESPONSIBILITIES
The Member is responsible for the condition and appropriate use of the Pavilion and event areas by the Member and their guests.
Setup & Decorations
Decorations are permitted provided they do not damage LPOA property. Nails, screws, tacks, staples, permanent adhesives, or other materials that may damage Pavilion surfaces are prohibited. All decorations, signs, balloons, tape, string, and other event materials must be removed following the event.
Cleanup
Cleanup must be completed before the Member leaves the Pavilion and within the approved reservation period, unless other arrangements have been approved by LPOA.
Following the event, the Member must:
- Leave tables and surfaces reasonably clean;
- Remove decorations and personal belongings;
- Remove or properly dispose of food and beverages;
- Place trash in designated receptacles or remove it if receptacles are full;
- Collect litter from the Pavilion, parking area, and immediate event area;
- Return authorized LPOA equipment to its proper location;
- Turn off lights and equipment when appropriate; and
- Secure gates, doors, locks, and other secured areas accessed during the event.
Please leave the Pavilion and surrounding area in the same or better condition than you found it.
6. KEYS, ACCESS & LPOA EQUIPMENT
LPOA keys, combinations, access codes, and other access credentials are issued only through the authorized LPOA process. Members may not loan, transfer, duplicate, or provide an LPOA key, combination, or access code to another person. A Pavilion reservation does not authorize access to LPOA storage areas, maintenance equipment, supplies, or other secured property unless specifically approved. The Pavilion sound system and light-control equipment may be accessed only as authorized by LPOA and must be secured after use. Lost keys or compromised access information must be reported promptly.
7. CHILDREN & GUESTS
The Member is responsible for the conduct of all guests and participants associated with the reservation. Children and minors must be appropriately supervised by a responsible adult. The Pavilion and surrounding common areas include or are located near water, a boat ramp, playground equipment, parking areas, roadways, uneven ground, and other outdoor recreational features. Parents, guardians, and event hosts remain responsible for supervising children and guests. The Member’s responsibility under this Agreement applies regardless of whether the event is primarily for the Member, a child, family member, guest, or invited group.
8. HOURS, NOISE & NEIGHBOR CONSIDERATION
Quiet hours are 10:00 p.m. to 9:00 a.m.
Events, including cleanup and departure of guests, should be completed by the end of the approved reservation period and in a manner consistent with quiet hours. Exceptions require prior approval from LPOA. Music, amplified sound, vehicles, and other activities must remain at a reasonable level and be conducted with consideration for nearby residents.
9. PARKING & ACCESS
Members are responsible for encouraging guests to park safely and appropriately.
Vehicles may not obstruct:
- Roadways;
- Residential driveways;
- Boat-ramp access;
- Gates;
- Emergency or service access; or
- Other vehicles.
Emergency access must remain available at all times.
10. CONDUCT
Events must respect the safety, property, and reasonable enjoyment of other Lakewood residents.
The following are prohibited:
- Illegal activity;
- Disorderly, threatening, or dangerous conduct;
- Intentional damage or misuse of LPOA property;
- Unauthorized access to secured areas;
- Excessive or unreasonable noise;
- Activities creating an unreasonable safety hazard; and
- Conduct substantially interfering with other residents’ lawful use of Lakewood common areas.
Serious or repeated violations may result in termination of an event and/or suspension of future Pavilion reservation privileges. Law enforcement or emergency services may be contacted when circumstances warrant.
11. DAMAGE & COSTS
The Member is responsible for damage caused by the Member or their guests to the Pavilion, equipment, landscaping, or other LPOA property. Members should report any pre-existing damage discovered upon arrival. Damage occurring during an event must be reported promptly.
The Member agrees to reimburse LPOA for reasonable repair, replacement, or extraordinary cleanup costs resulting from damage, misuse, or conditions caused by the Member or their guests.
12. EMERGENCIES
For a life-threatening or immediate emergency, call 911 first. The Member should notify an LPOA Board representative of any significant emergency, injury, property damage, or safety incident occurring in connection with the reservation as soon as reasonably possible. Any emergency equipment provided at the Pavilion, including an AED if installed, is intended for emergency use and should be used according to the equipment’s instructions.
13. ASSUMPTION OF RESPONSIBILITY & RISK
The Pavilion and surrounding areas are community recreational facilities. Their use may involve ordinary risks associated with outdoor and recreational activities, including risks associated with water, weather, playground equipment, vehicles, uneven surfaces, cooking equipment, and other people using the property.
The Member voluntarily accepts the ordinary risks associated with use of the Pavilion and surrounding common areas and accepts responsibility for supervising and protecting the Member’s guests and personal property.
Members and guests are responsible for exercising reasonable care for their own safety and the safety of children or others under their supervision.
LPOA does not guarantee that the Pavilion or surrounding recreational areas will be free from every hazard or risk ordinarily associated with their use.
LPOA is not responsible for lost, stolen, or damaged personal belongings.
14. MEMBER RESPONSIBILITY FOR CLAIMS
The Member accepts responsibility for losses, damage, injuries, or claims caused by the Member or the Member’s guests through their actions, misconduct, misuse of Association property, or failure to follow this Agreement. The Member agrees to be responsible for reasonable costs incurred by LPOA as a direct result of such conduct, to the extent permitted by law.
15. ENFORCEMENT
LPOA may take reasonable action when this Agreement is violated, including:
- Requiring an unsafe or prohibited activity to stop;
- Ending an event when necessary to protect people or property;
- Requiring payment for damage or extraordinary cleanup caused by the event;
- Suspending or denying future Pavilion reservation privileges for serious or repeated violations; and
- Contacting law enforcement or emergency services when appropriate.
16. LPOA AUTHORITY
LPOA may adopt or modify reasonable Pavilion rules and procedures as needed for the safety, maintenance, security, and appropriate use of Association property. The rules and reservation requirements in effect when a reservation is approved will apply to that reservation.
MEMBER ACKNOWLEDGMENT
By signing or submitting a Pavilion Reservation Request, I acknowledge and agree that:
- I have read and understand the Lakewood Pavilion Use Agreement.
- I am at least 18 years old and am an eligible dues-paying LPOA member.
- I am the responsible Member for this reservation and will be present during the event.
- I understand that my reservation is for the approved reservation period and is not transferable.
- I am responsible for the conduct of my guests, household members, children, and invited participants.
- I understand that use of the Pavilion and surrounding recreational areas involves ordinary risks.
- I am responsible for appropriately supervising children and guests attending my event.
- I will complete cleanup and secure the Pavilion before leaving.
- I will not loan, transfer, duplicate, or provide an LPOA key or access credential to another person.
- I will report significant damage or safety incidents.
- I accept responsibility for reasonable repair, replacement, or extraordinary cleanup costs caused by me or my guests.
- I agree to follow this Agreement, applicable LPOA rules, and applicable law.
- I understand that serious or repeated violations may result in loss of future Pavilion reservation privileges.
