Lakewood Property Owners Association Pavilion Use Agreement
This Pavilion Use Agreement (“Agreement”) is made and entered into by and between LPOA and the Member (and their users, guests, group, “Member”) for the use of the Lakewood Pavilion (“Pavilion”).
1. Purpose of Use: The Pavilion is for the primary use and enjoyment of LPOA Members, and to be used for social, recreational, and non-commercial purposes only. The Pavilion may not be used for any illegal, immoral, or commercial activities. Any exceptions for business or commercial activities require prior written approval from the LPOA Board.
2. Eligibility: To reserve the Pavilion, the member must be a due-paying member.
3. Reservation: The Pavilion must be reserved in advance with the LPOA Pavilion Reservation Request form and is available on a first-come, first-served basis.
- The Member must provide a valid phone number where they can be reached on the day of the event in case of emergencies or issues.
- The Pavilion may be reserved only during the approved time frame. The Members are to ensure their guests vacate the premises at the end of the scheduled time to allow for subsequent events.
- The Member agrees to adhere to all LPOA rules and local/State regulations regarding noise, safety, and parking. Inappropriate behavior or failure to comply with these rules may result in referral to local law enforcement and the loss of future facility use and reservation privileges.
4. Cancellations and Changes: The LPOA reserves the right to cancel or reschedule reservations in the event of unforeseen circumstances (e.g., maintenance, inclement weather, etc.).
5. Responsibilities of the Members:
- The Member is responsible for setting up and cleaning up the Pavilion, parking lot and all other areas used. All decorations must be removed after the event, and secure any gates and locks. No nails, tacks, or other permanent fixtures are allowed.
- The Pavilion, parking lot and all other areas used must be left in the condition in which it was found. The Member agrees to clean up and dispose of all trash in the designated receptacles or take it with them.
- Quiet hours are from 9pm – 9am; Exceptions may be granted by prior written approval of the LPOA. Any activities that may disturb neighboring properties should be conducted in a respectful manner.
- Equipment and supplies stored adjacent to the Pavilion are not to be used without prior written approval of the LPOA. Sound system and light control box may be accessed by Member key. Secure when leaving.
- The Member must ensure that all guests and participants are aware of and adhere to the LPOA’s rules and guidelines while using the Pavilion and surrounding areas.
- The Member is responsible for any damage caused to the Pavilion, equipment, or surrounding property during the event. The Member agrees to reimburse the LPOA for any damages or necessary repairs resulting from their event.
- Users agree to comply with all state, local, and federal laws, including health and safety regulations (e.g., fire safety, food handling, etc.).
5. Liability: The LPOA is not responsible for any accidents, injuries, or damages that occur before, after or during the event. The Member assumes full liability for any claims, damages, or injuries that may occur related to the use of the Pavilion, including but not limited to the parking area, playground areas, boat ramp area or lakes.
6. Indemnification: The Member and all users agree to indemnify, defend, and hold harmless the LPOA, its directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses arising from the Member’s use of the Pavilion, parking lot, play grounds, lakes and all other areas used including but not limited to property damage, personal injury, or any violation of laws or LPOA rules.
8. Conduct and Behavior:
- All events must be conducted in a manner that respects the comfort, safety, and rights of other residents in the community.
- Disorderly conduct, including excessive noise, alcohol abuse, or disruptive behavior, will result in immediate termination of the event.
9. Emergency Response Procedures: In case of emergency, the Member or users must call 911 and inform the LPOA immediately.
10. Additional Provisions:
- The LPOA reserves the right to modify or amend this Agreement as needed. The Members will be informed of any changes.
- The Member, users and guests agree to the use of any photographs or video recordings of the event for LPOA promotional purposes, unless otherwise stated in writing.
11. Agreement Acknowledgment: By submitting a request below, the Member acknowledges that they have read, understood, and agree to the terms and conditions outlined in this Pavilion Use Agreement.
