Lakewood Property Owners Association Pavilion Use Agreement

This Pavilion Use Agreement (“Agreement”) is made and entered into by and between Lakewood Property Owners Association and the undersigned Resident/Resident Group (“Renter”) for the use of the Lakewood Pavilion (“Pavilion”).

1. Purpose of Use: The Pavilion is to be used for social, recreational, and non-commercial purposes only. The Pavilion may not be used for any illegal, immoral, or commercial activities. Any exceptions require prior written approval from the HOA.

2. Eligibility: To reserve the Pavilion, the Renter must be a due-paying member.

3. Reservation: The Pavilion must be reserved in advance through the either communication with LPOA President, Fred Becker, LPOA Secretary, Madison Woodward, or the LPOA Pavilion Reservation Request form and are available on a first-come, first-served basis.

  • The Pavilion may be reserved only during the approved time frame. The Renter must vacate the premises promptly at the end of the scheduled time to allow for subsequent events.
  • The Renter is responsible for setting up and cleaning up the Pavilion. All decorations must be removed after the event. No nails, tacks, or other permanent fixtures are allowed.
  • The Pavilion must be left in the condition in which it was found. The Renter agrees to clean up and dispose of all trash in the designated receptacles.
  • Amplified music is only allowed at the discretion of the HOA and must comply with local noise ordinances. Any outdoor activities that may disturb neighboring properties should be conducted in a respectful manner.
  • The Renter agrees to adhere to all HOA rules and regulations regarding noise, safety, and parking. Inappropriate behavior or failure to comply with these rules may result in the loss of the deposit and future reservation privileges.

4. Responsibilities of the Renter

  • The Renter must ensure that all guests and participants are aware of and adhere to the HOA’s rules and guidelines while using the Pavilion and surrounding areas.
  • The Renter is responsible for any damage caused to the Pavilion, equipment, or surrounding property during the event. The Renter agrees to reimburse the HOA for any damages or necessary repairs resulting from their event.
  • The Renter must provide a valid phone number where they can be reached on the day of the event in case of emergencies or issues.
  • The Renter agrees to comply with all state, local, and federal laws, including health and safety regulations (e.g., fire safety, food handling, etc.).

5. Liability: The HOA is not responsible for any accidents, injuries, or damages that occur during the event. The Renter assumes full liability for any claims, damages, or injuries that may occur during the use of the Pavilion.

6. Cancellations and Changes

  • Cancellation by HOA: The HOA reserves the right to cancel or reschedule reservations in the event of unforeseen circumstances (e.g., maintenance, inclement weather, etc.).

7. Indemnification

  • The Renter agrees to indemnify, defend, and hold harmless the HOA, its directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses arising from the Renter’s use of the Pavilion, including but not limited to property damage, personal injury, or any violation of laws or HOA rules.

8. Conduct and Behavior

  • All events must be conducted in a manner that respects the comfort, safety, and rights of other residents in the community.
  • Disorderly conduct, including excessive noise, alcohol abuse, or disruptive behavior, will result in immediate termination of the event and loss of deposit.

9. Emergency and Safety Procedures

  • In case of emergency, the Renter must call 911 and inform the HOA immediately.
  • The Renter is responsible for ensuring that all guests are familiar with emergency exits and procedures in the event of fire or other emergency situations.

10. Additional Provisions

  • The HOA reserves the right to modify or amend this Agreement as needed. The Renter will be informed of any changes at the time of booking.
  • The Renter agrees to the use of any photographs or video recordings of the event for HOA promotional purposes, unless otherwise stated in writing.
